These terms are an agreement between you and TOPSOL ("we", "us"), a company registered in Pakistan that publishes the Kranigo app ("Kranigo" or "the app"), about your use of the app. By installing or using the app you accept these terms. If you do not accept them, do not use the app.
1. Safety disclaimer: planning aid only
Planning aid only. Verify against the manufacturer's load chart, the crane's RCI/LMI and site conditions. A competent person must approve this plan.
Kranigo is a planning aid for competent crane professionals. It is not an approval, certification or engineering tool. In particular:
- Kranigo does not replace a competent person. Every lift must be planned, checked and approved by a suitably qualified and competent person under the laws, standards and procedures that apply to your site.
- Kranigo does not replace the manufacturer's load charts. The manufacturer's load chart and operating manual for the actual crane and configuration are the authority. Kranigo only works with the data you enter.
- Kranigo does not replace lift plans, method statements or site rules. It does not replace your company's lift procedures, permits, risk assessments or the crane's rated capacity indicator or load moment indicator (RCI/LMI).
- You are responsible for verifying every value you enter and every value Kranigo shows, including crane dimensions, configurations, load weights, radii, heights, clearances and capacities, before relying on them.
- Drawings and figures are approximations based on your inputs. Clearances are measured in a two-dimensional side view and do not model line sag, sway, wind or ground movement. Site conditions change and must be checked on the day.
If anything in the app looks wrong, stop and check before you lift.
2. Licence to use the app
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use Kranigo on devices you own or control, for your own work or your organisation's internal work, in line with these terms and the rules of the store you downloaded it from (Apple App Store or Google Play).
You must not copy, modify, reverse engineer, resell or redistribute the app, except where the law gives you a right to do so that cannot be excluded.
3. Your content
Projects, cranes, settings and other content you create stay on your device and belong to you (or to whoever owns them under your arrangements). We do not receive them. You are responsible for keeping your own copies, for example through your device backups or by exporting PDFs.
You confirm that you have the right to use any information you enter into the app, such as crane data or load-chart values taken from documents owned by others.
4. Sample content
The sample cranes, charts and projects included with the app are fictional and exist only to show how the app works. They do not describe any real crane and must never be used to plan a real lift.
5. No warranty
Kranigo is provided "as is" and "as available". To the extent the law allows, we make no promise that the app is free of errors, that it will always be available, or that its results are fit for any particular purpose. Some laws give you consumer rights that cannot be excluded; nothing in these terms limits those rights.
6. Limitation of liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to limit or exclude.
Subject to that:
- You remain responsible for every lift. We are not liable for loss or damage that results from lifting operations or from decisions made using the app, where the inputs or results were not verified and approved as described in section 1.
- We are not liable for loss of profit, revenue, business, contracts, data or goodwill, or for any indirect or consequential loss.
- Our total liability to you for all claims about the app is limited to the greater of the amount you paid for the app and £100.
7. Changes and ending
We may update the app and these terms. If we change the terms, we will update the "Last updated" date and show the new terms in the app; if the safety disclaimer changes, the app will ask you to accept it again. You may stop using the app at any time by deleting it.
8. Governing law
These terms, and any dispute about them or the app, are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you use the app as a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in your local courts.
9. App stores
These terms are between you and TOPSOL only, not Apple or Google. Apple and Google are not responsible for the app, its content, its maintenance or support, or any claim about it.
If you downloaded Kranigo from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies, and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation for the app.
